It is a First Degree Felony if while committing the Robbery the person uses or exhibits a weapon, causes bodily injury or death, or the victim is 65 years of age or over, or is disabled. Punishment ranges from 5 to 99 years, with a fine of up to $10,000.00 A simple shop lifting can turn into a robbery if you use force. I have been successful in getting a robbery reduced to a misdemeanor. My client told me that he never used forced and I subpoenaed the video before it was destroyed.
