The offense is committed when an individual causes serious bodily injury or bodily injury to a person who is 14 years old or younger.

If the behavior was done intentionally or knowingly with the result causing serious bodily injury or serious mental impairment or mental injury it is a First Degree Felony. If the conduct was reckless, it is a State Jail Felony.

If the conduct was done either intentionally or knowingly with the result causing bodily injury, it is a third Degree Felony. If the conduct was done recklessly it is a State Jail Felony.

I have received several no bills from the grand jury on these types of cases.
